The protection of your personal data is important to us. We process your data solely on the basis of the statutory provisions (GDPR). Below we inform you about the key aspects of data processing on this website.

2. Data minimisation
Only technically necessary data and – for reach measurement – the usage data collected via Google Analytics 4 (GA4) is processed. No further third-party tracking takes place; the analytics used on this website is carried out solely via GA4 as detailed in section 8 below. We do not use marketing cookies.
3. Provision of the website and server log files
When you access this website, the hosting provider automatically processes technical access data (e.g. IP address, date and time of access, page requested, volume of data transferred, browser type) in server log files. This serves the secure and stable operation of the website. The legal basis is our legitimate interest in an error-free provision (Art. 6(1)(f) GDPR).
4. Contact (form, email, WhatsApp)
Via the contact or enquiry form we collect the fields you enter (name, company, email, optional phone, message) and forward them by email tooffice@bergfrieden.consulting. If you contact us by email or WhatsApp, we process the details you provide in order to handle your request. The legal basis is Art. 6(1)(b) GDPR (pre-contractual measure or performance of a contract) as well as our legitimate interest in responding to your enquiry (Art. 6(1)(f) GDPR). The data is used only to handle your request, not for newsletters or advertising, and is not passed on to uninvolved third parties.
5. WhatsApp and AI assistant (EU AI Act)
Our WhatsApp contact option is an automated, AI-assisted channel. For transparency under the EU AI Act, every WhatsApp link on this website opens the chat with a pre-filled greeting that expressly identifies the sender as an AI assistant of Bergfrieden Consulting, reading:“Hello, I am an AI assistant from Bergfrieden Consulting. I will help you with your questions and escalate to a human if needed.” This message is only prepared in your WhatsApp input field; it is not sent until you confirm it. You therefore immediately recognise that you are first interacting with an AI system and that your request will be escalated to a human if needed. The details you share via WhatsApp are processed to handle your request (Art. 6(1)(b) and (f) GDPR); the provider's own privacy policy additionally applies to transmission within WhatsApp (see section 7).
6. Newsletter
If you sign up for updates, we process your email address solely on the basis of your consent (Art. 6(1)(a) GDPR) in order to send you occasional information about our offering. You can withdraw your consent at any time with effect for the future, for example by emailingoffice@bergfrieden.consulting.
7. External links and services
This website contains links to external offerings (e.g. Marblism, LinkedIn, WhatsApp). When you follow these links, the privacy policies of the respective providers apply. We have no influence over their data processing. Marblism, the AI service we recommend, runs on AWS in the United States (us-east-1), secured by EU Standard Contractual Clauses (SCCs) and a Data Processing Agreement (DPA) – a familiar and manageable compliance setup for our clients.
8. Google Analytics 4 (GA4)
This website uses Google Analytics 4 (GA4), a web analytics service provided byGoogle Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), where applicable involving Google LLC (USA). GA4 is used for web analytics and audience measurement: we evaluate how visitors use our website (e.g. pages visited, approximate origin, device type, time spent) in order to improve our offering.
The data collected via GA4 is also processed in the United States (Google servers, including the us-east-1 region). For this transfer to a third country we rely on the EU Standard Contractual Clauses (SCCs) pursuant to Art. 46 GDPR, together with supplementary safeguards; Google is additionally certified under the EU-US Data Privacy Framework.
The legal basis for the processing is our legitimate interest in optimising and economically providing our website (Art. 6(1)(f) GDPR).
You can object to collection by GA4: prevent the storage of cookies via your browser settings, or stop Google from collecting your data by installing the browser add-on to deactivate Google Analytics, available athttps://tools.google.com/dlpage/gaoptout. Alternatively, an opt-out cookie can be set that prevents future collection on this website.
9. Recipients and processors
To provide the website we use a hosting service provider that processes the data on our behalf and subject to our instructions (processing agreement pursuant to Art. 28 GDPR). Your data is only passed on to other third parties where required by law or where you have consented.
10. Retention period
We store personal data only for as long as is necessary for the stated purposes or as statutory retention periods require. Enquiry data is deleted once your request has been conclusively handled, unless legal obligations prevent this.

Under the GDPR you have the following rights:

For security reasons, this website uses SSL/TLS encryption to protect the transmission of confidential content. You can recognise an encrypted connection by the “https://” in your browser’s address bar.
13. Validity and changes
This privacy policy is currently valid. Further development of our website or changes to statutory requirements may make amendments necessary. The version published on this page applies in each case.
